Encryption scrambles the data so that it cannot be read without the
appropriate decryption. The way the DMCA is written, it considers
technologies like encryption to be a form of "access control". Other
techniques like authentication or authorization measures used in DRMs
can also be interpretted by the DMCA to be forms of access control.
Then the DMCA says you can't bypass access controls.

There are some products designed to resemble CDs that do contain DRM.
Recall the whole Key2Audio mess a few years? It works by putting bogus
data on a normal audio CD that causes some computers to fail to read the
CD (and thus prevent copying). People got creative and found out that
using a green felt-tip market could be used to cover-up the bogus data.
This mess hasn't gone away because it is still be used in various
commericial music releases. Check out a music shop. Notice that some
CD cases do not show the phrase "Compact Disc(tm)". This is a dead
giveaway for the Key2Audio DRM-infested discs.
BTW, just because it's a law doesn't mean it should be followed. For
example, in Mississippi, being a parent of at least two illegitimate
children is punishable by at least 1-month jail time.

punishable with a $500 fine and 6-month prison time.
